TERMS AND CONDITIONS OF THE "GIVEAWAY" CONTEST ON SHITCOINS.CLUB'S FACEBOOK PROFILE

§ 1. GENERAL PROVISIONS

(1) The organizer of the Facebook contest, is Wirtualna Planeta spółka z ograniczoną odpowiedzialnością with its registered office in Toruń (87 - 100), at 14 Pod Krzywą Wieżą Street (hereinafter referred to as "Organizer").

(2) The organizer is the founder of the prize.

(3) The administrator of the personal data provided by the Contest Participants is the Organizer.

(4) These Regulations set forth the terms and conditions of the Competition.

5 The contest is not created, administered, supported or sponsored by Facebook. Facebook is a trademark registered by Facebook, Inc.

6 The contest is conducted on Shitcoins.club's Facebook profile and reposted to other channels.

7 The Organizer shall supervise the correctness and course of the Contest, i.e. providing information about the Contest and handling complaints.

§ 2. COMPETITION PARTICIPANTS

(1) Participants of the Contest may only be natural persons, consumers as defined by Article 221 of the Civil Code, with full legal capacity, who are users and have an active account on Facebook.com or other social media of the company, who have accepted these Regulations (hereinafter: "Participant").

(2) The participant declares that:

a. is a natural person with full legal capacity;

b. has read the contents of these Regulations and voluntarily enters the Contest;

c. agrees and accepts the terms and conditions of the Terms and Conditions, including having read and fully accepting the contents regarding the procedure for receiving the prize;

d. undertakes to abide by the provisions of the Terms and Conditions, including the Facebook Terms and Conditions;

e. has consented to the processing of personal data for purposes related to participation in the Contest;

f. is a registered User of Facebook or other social networking sites.

§ 3 AWARD

(1) The Contest provides a prize - for one person selected in the manner indicated in §6.

(2) The prize is EUR 50, which can be paid in Bitcoin ATM

3. information about the Prize will be included in the content of the Contest announcement published on Facebook and Instagram

4 Winners are not entitled to exchange the Prize for a prize of any other kind.

(5) Winners may relinquish the Prize, but in return they shall not be entitled to any cash equivalent or any other prize.

§ 4. PLACE, TIME AND RULES OF THE COMPETITION

1. the Contest is available in the form of a contest announcement (hereinafter: "contest post") on Facebook on the Organizer's profile at Shitcoins.club

2 The contest runs from 30.09.2022. until 20.10.2022 

3. the results of the competition will be announced on October 24, 2022

§ 5. RULES OF PARTICIPATION IN THE COMPETITION

(1) The task of the Contest Participant using Facebook is:

a. On Facebook, create an original meme about cryptocurrencies and add it in the comments under the post.

b. Adding feedback on Google maps to the nearest location of Bitcoin ATM Shitcoins.club, which the contest participant usually uses

c. Liking or using the "Follow" button on any other Shitcoins.club social media channel available at https://linktr.ee/Shitcoinsclub

(2) The task of the Contest Participant using Instagram is:

a. Share the original meme about Bitcoin ATM on your profile on Instagram using the hashtag #shitcoinsgiveaway

b. Adding feedback on Google maps to the nearest location of Bitcoin ATM Shitcoins.club, which the contest participant usually uses

c. Liking or using the "Follow" button on any other Shitcoins.club social media channel available at https://linktr.ee/Shitcoinsclub

2. information about the contest will be available on Facebook at Shitcoins.club

§ 6. CONDITIONS OF PARTICIPATION IN THE COMPETITION AND RECEIPT OF PRIZES

(1) Access to the Contest is free and requires registration on Facebook or Instagram

(2) Condition for participation in the Contest is acceptance of the Regulations and the correct performance of all tasks described in § 5. Paragraph 1 of the Regulations.

(3) The awarding of the prize shall be decided by the Organizer by analyzing the correctness and attractiveness of the performance of the tasks described in § 5. Paragraph 1 of the Regulations by the Contest Participants.

(4) From among the submitted entries, the Organizer will select one winner.

(5) The winner of the Contest will be notified of the prize and the conditions for collecting the Prize via a private message sent on Facebook or on Instagram (depending on your profile) within 3 business days after the end of the contest.

6. public information about the winner will also be posted in a comment on the contest post on Shitcoins.club

(7) The prizewinning Participant is required to send a private message within 72 hours of the announcement of the results of the Contest on the site - a private message. The Organizer is then to verify that the winner has met the above 3 conditions.

(8) Failure to send the message referred to in item. 7, or exceeding the permissible response time, or sending incorrect data, or failing to meet the 3 conditions of the contest described in § 5, causes the participant to forfeit the right to the prize. The prize then passes to the next person.

(9) The prize awarded in the Contest will be sent to the participant up to 20 calendar days after the Organizer receives the information referred to in paragraph 6.

10. prizes will be sent at the expense of the Organizer in electronic form to the email address indicated by the Participant or by message on Facebook or Instagram, if he/she so wishes.

§ 7. ORGANIZER'S RESPONSIBILITIES

(1) The Organizer shall not be responsible for the accuracy and truthfulness of the data of the Contest Participants, including the inability to transfer prizes, for reasons attributable to the Participant, in particular, if the Participant did not provide a true mailing address or the data provided is incomplete or outdated.

(2) The Organizer declares that it does not control or monitor the content posted by Participants in terms of reliability and truthfulness, subject to actions related to the removal of violations of the Terms of Use or generally applicable laws.

(3) The Organizer reserves the right to exclude from participation in the Contest Participants whose actions are in violation of the law or the Regulations and Facebook rules, in particular, participants who:

a) post content that is inconsistent with applicable law or the Regulations available on Facebook (in particular, content that is offensive, both in text and graphics);

b) take actions using an account/profile created in violation of Facebook rules;

(c) take actions using third-party accounts/profiles that do not comply with Facebook rules;

(d) interfere with the mechanism of the Competition;

(e) create fictitious accounts/profiles on Facebook or other sites, especially GoogleMaps

(f) post on GoogleMaps not sincere opinions about Bitcoin ATM, and unrelated to Bitcoin ATM messages like "I hope I win" and the like

g) place an opinion on another company's GoogleMaps business card or on a business card of a location other than Bitcoin ATM. The list of relevant Bitcoin ATMs in Poland is available at the link Bitcoin ATMs

(4) The organizer is not responsible for any malfunctions in the operation of data communications links, servers, interfaces, browsers and the Facebook or Instagram platform

(5) The organizer shall not be responsible for the temporary or permanent blocking of a page or application from Facebook or Instagram

§ 8. PROCESSING OF PERSONAL DATA

(1) The personal data of the Contest Participants will be processed by the Organizer only for the purpose of performing activities necessary for the proper conduct of the Contest.

(2) The personal data of the Contest Participants will be kept by the Organizer only for the period necessary to conduct the Contest and to issue prizes to the awarded Participants.

(3) Participants have the right to inspect the processed data and to correct and delete them. Data is provided on a voluntary basis, with registration on Facebook required for participation in the Contest.

(4) At the time of deletion of data, the user loses the opportunity to participate in the Contest.

§ 9. COPYRIGHT

(1) All intellectual property rights to the Contest shall be vested in the Organizer. Participation in the Contest does not in any way result in the acquisition of any intellectual property rights by the Participants. It is forbidden to infringe intellectual property rights in the Contest in any way, in particular:

(a) copying, modifying and electronically transmitting or otherwise distributing the mechanism of the Competition or parts thereof, as well as individual works and 

databases, without the express written consent of the Administrator;

(b) use of the Contest in a manner inconsistent with the Regulations or generally applicable laws.

§ 10. COMPLAINTS AND REPORTS OF VIOLATIONS

(1) Any complaints regarding the manner in which the Contest is conducted, Participants should submit in writing during the Contest, but no later than within 14 (fourteen) days from the date of issuance of the Prize

(2) A complaint submitted after the deadline shall have no legal effect.

(3) The written complaint should contain the name, surname, exact address of the Participant and a detailed description and justification of the complaint.

(4) The complaint should be sent by electronic mail to the Organizer's address support@shitcoins.club

(5) Complaints will be processed in writing and via e-mail within 30 days.

§ 11. FINAL PROVISIONS

(1) The Regulations shall enter into force on 30.09.2022 and shall remain in force until 20.10.2022.

(2) In matters not covered by these Regulations, the provisions of the Civil Code and other provisions of law shall apply.

(3) Disputes relating to and arising from the Contest shall be resolved by a common court of competent jurisdiction over the registered office of the Organizer.
